When you subscribe to the Eleable service through Stripe, the following information is typically collected:

Privacy and Confidentiality

Privacy Policy:
All personal and business information shared with Gabrie'le Eato LLC will be handled in compliance with applicable privacy laws.

Confidentiality in Agreements:
All parties agree to maintain confidentiality of information shared during business engagements unless disclosure is required by law or specifically agreed upon in writing.

Dispute Resolution and Governing Law

Arbitration Clause:
Any disputes arising under these terms or related agreements shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
Arbitration shall be conducted in California and governed by the laws of California. The arbitrator's decision shall be final and binding on all parties.
Court Jurisdiction:
If arbitration is unsuccessful or deemed unenforceable, disputes shall be resolved in the courts of Los Angeles County, California, under applicable state and federal laws.

Severability

If any provision of this policy is found to be invalid, unenforceable, or illegal, the remaining provisions shall remain in full force and effect.

No Waiver

Failure by Gabrie'le Eato LLC to enforce any provision of this policy does not constitute a waiver of that provision or any other provision.

Effective Dates

January 1, 2017: Historical practices regarding verbal agreements and their acceptance.
January 18, 2025: Updates requiring all new agreements to be documented in writing, with acknowledgment of receipt.

Virtual Agreements & Optional Witness

For agreements made remotely, the following terms apply:

Witness Process: Witnesses for virtual agreements may sign electronically or provide a written statement or video recording to validate their presence. Witnesses are recommended but not required.
Risks Without a Witness: In the absence of a witness, the party opting out of witness validation assumes the burden of proof in any dispute regarding the authenticity or terms of the agreement. The absence of a witness may also weaken the enforceability of the agreement.

Digital Signatures

Digital signatures are considered legally valid and enforceable under the Electronic Signatures in Global and National Commerce Act (ESIGN Act), provided they are verified through a recognized electronic signing platform (e.g., DocuSign, Adobe Sign).

Customized Plans and Subscription Terms
Customized service plans offered by Gabrie'le Eato LLC, Eleable LLC, or NUNITY—including but not limited to website development, branding, digital strategy, and consulting—are billed according to the terms agreed upon at the time of purchase. By subscribing through Stripe, the client acknowledges and accepts the specific terms of the customized plan, including the full payment schedule, scope of services, and duration. All customized service plans are non-refundable once initiated, regardless of usage or client participation. Continuation of services beyond the original term requires a new subscription agreement and may be subject to updated pricing and terms. Gabrie'le Eato LLC reserves the right to modify plan offerings at its discretion with proper notice.

Expert Witness and Consulting Disclaimer

While Gabrie'le Eato LLC may provide expert analysis, case evaluations, and consulting services related to neurodivergence and disability law, these services are not intended as legal representation.

Any expert testimony or consulting insights offered are based on Gabrie'le Eato's professional experience and evaluations and should not be considered as legal advice. Legal decisions should be made in consultation with a licensed attorney.

Refund Policy

All purchases, including but not limited to customized service plans, subscriptions, digital services, and consulting packages, are non-refundable. By proceeding with payment, you acknowledge and agree that all sales are final, regardless of usage, satisfaction, or client participation. Exceptions may only be made at the sole discretion of Gabrie'le Eato LLC and must be documented in writing.

Service-Specific Terms

Each service offered by Gabrie'le Eato LLC, Eleable LLC, and NUNITY may have additional or service-specific terms presented at the time of purchase or engagement. By proceeding with any service, you agree to be bound by those additional terms, which are incorporated by reference into this agreement.

Revision and Dissatisfaction Policy

Clients must notify Gabrie'le Eato LLC and/or Eleable LLC in writing via email (No other means will be accepted.) within five (5) calendar days of project delivery if they are dissatisfied with any aspect of the work. This written notice must clearly outline the specific corrections requested within forty-eight (48) hours of the initial dissatisfaction notice.

Failure to provide clear written correction requests within the 48-hour window will result in the project being deemed accepted and complete. Once a project is marked complete, any further revisions, corrections, or modifications will require a new agreement and will be billed at the current applicable rates.

GDPR Compliance (for EU Clients)
If you are a resident of the European Union, you are entitled to rights under the General Data Protection Regulation (GDPR), including the right to access, correct, or delete your personal data. Requests related to your data can be submitted to heygab@proton.me.

Certificates of Completion

Upon successful completion of a customized service plan and full payment of the agreed amount, clients may receive a Certificate issued by Gabrie'le Eato LLC, Eleable LLC, or NUNITY. This certificate is provided solely as a professional courtesy to document service engagement and is not a legal credential, licensure, or certification. Issuance is at the discretion of the provider and may require client request.

Age Limit and Parental Consent

Our services and website are intended for users who are 18 years of age or older. By accessing or using the services of Gabrie'le Eato LLC, Eleable LLC, or NUNITY, you confirm that you are at least 18 years old. If you are under 18, you may only use our services under the supervision and with the consent of a parent or legal guardian. We do not knowingly collect personal information from individuals under the age of 18 without verifiable parental consent.

Gabrie'le Eato LLC, Eleable LLC, and NUNITY are not responsible for the functionality, availability, security, or data practices of any third-party services. Your use of third-party platforms is subject to their respective terms of service and privacy policies. We encourage clients to review those policies independently.

Account Setup, Secure Communications & Third-Party Services

To ensure secure, efficient project delivery, you agree that by using services provided by Gabrie'le Eato or Eleable LLC, accounts may be created on your behalf with third-party service providers, including but not limited to ProtonMail (for encrypted email), Hostinger or WordPress (for web development), and other relevant platforms.

These accounts are used solely for the purpose of fulfilling project goals. You retain ownership of all accounts created on your behalf. Login credentials will be provided to you upon request or at the completion of services. Eleable LLC may temporarily manage these accounts as part of the service process, with your implied consent upon engagement.

Please note: Eleable LLC is not affiliated with or legally responsible for the operations, policies, or performance of any third-party platforms. By using our services, you agree that Eleable LLC shall not be held liable for any loss, damages, service interruptions, data breaches, or other issues caused by these external providers.

Grandfathered Plans Disclaimer

Gabrie’le Eato LLC, Eleable LLC, and NUNITY have previously offered “grandfathered” or legacy plans to early clients at reduced rates. These plans were extended on a limited basis and reflect service models and pricing that are no longer available. Grandfathered plans are honored as outlined at the time of purchase but are not subject to retroactive changes, reinterpretations, or additions unless agreed upon in writing.

Clients enrolled in any grandfathered plan received services based on the scope and terms agreed to at the time, which may have included website development, consulting, and strategic support. These plans may have included unlimited support, defined solely as non-implementation guidance—such as strategy, feedback, and consulting sessions.

Grandfathered plans do not include any form of hands-on implementation. This includes, but is not limited to:

Creating or posting content
Uploading assets or managing edits
Performing updates, integrations, or technical adjustments beyond launch

Implementation services are now exclusively available through current Eleable service plans, which may include hands-on support depending on the individualized scope of collaboration. The extent of implementation must be agreed upon in writing and tied to a current subscription plan. No verbal statements, gestures of goodwill, or previous communications override the documented service scope.

Important: If a client chooses to cancel or terminate their grandfathered plan, for any reason, they forfeit the legacy offer and pricing permanently. Re-enrollment will require purchase at the current public rates and under current terms at the time of re-subscription. Gabrie’le Eato LLC is not obligated to honor or reinstate any previously discontinued legacy plans.

Gabrie’le Eato LLC reserves the right to phase out, discontinue, or adjust legacy plan terms with 30 days’ written notice. All clients remain subject to the most recently updated Terms & Conditions.

Domain Ownership & Renewal Terms

All website packages provided by Gabrie'le Eato LLC, Eleable LLC, or NUNITY include complimentary domain registration for the first year, unless otherwise stated in writing. After the initial 12-month period, domain renewal becomes the client’s sole responsibility unless the client is enrolled in an active Eleable maintenance subscription.

As of April 19th, 2025, Clients who are actively subscribed to the Eleable $300/month maintenance plan at the time of renewal may have their domain cost covered as part of their subscription. This inclusion applies only if the annual domain renewal fee is $20 USD or less. Should the cost exceed this threshold, the client is responsible for the difference or full domain renewal cost, as determined by Eleable LLC.

Ownership of the domain is transferred to the client upon setup, and the client assumes responsibility for renewal, DNS management, and domain security unless otherwise agreed in writing. These terms are binding regardless of verbal agreements and are subject to the most recent written service scope.

Gabable™ Legal Terms & Disclaimers

Gabable™ is a proprietary service offering under Gabrie’le Eato LLC and is protected as a trademarked brand identity concept. All services provided under the Gabable™ name are consultative and creative in nature. Clients purchasing the Gabable™ Premium Presence Package acknowledge that:

The service is strategy-based and design-guided. Gabable™ is not an implementation service, and clients are responsible for uploading, publishing, and applying materials on their own platforms unless otherwise agreed upon in writing.
All work is subject to Gabrie’le Eato LLC’s non-refundable policy. Once services have been initiated, no refunds will be issued regardless of perceived satisfaction or level of participation.
By purchasing Gabable™, clients acknowledge that their deliverables will be based on the intake provided and may vary depending on the depth and quality of shared input.
Any additional consulting or work outside the defined scope must be purchased separately.
Gabable™ deliverables do not guarantee media placement, influencer brand deals, or increased visibility. Outcomes are dependent on client implementation, market response, and consistent brand use.

Gabable™ is the intellectual property of Gabrie’le Eato LLC and may not be reproduced, white-labeled, or redistributed without written consent. Unauthorized use of Gabable™ materials, methods, or branding is strictly prohibited and subject to legal enforcement.

Termination of Services

Either party may terminate services at any time with written notice. However, all fees paid prior to termination are non-refundable, and the client remains responsible for any outstanding balances due at the time of termination. Early termination of a customized plan does not release the client from agreed payment obligations.

This program was created to make high-quality digital services more accessible by allowing clients to negotiate a price that works for them—on their own terms. While pricing is flexible, all services under the GabCares initiative remain subject to the terms and conditions set forth by Gabrie’le Eato LLC and Eleable LLC.

Gabrie'le Eato LLC and/or Eleable LLC maintain a strict mutual respect policy. Professional, respectful communication is expected at all times. In the event that a client engages in disrespectful, abusive, harassing, or otherwise inappropriate behavior, Gabrie'le Eato LLC and/or Eleable LLC reserve the right to terminate, suspend, or modify the scope of services or agreements at their sole discretion, with or without notice.

In the event of termination or modification due to violation of this policy, the client remains responsible for all payments made and owed to date, and no refunds will be issued for completed or partially completed services. Any future services or support will be subject to a new agreement, if offered at all, at the discretion of Gabrie'le Eato LLC and/or Eleable LLC.

This policy is intended to ensure a positive and productive working relationship for all parties.

Eleable Certification Discretion Policy

The issuance of an Eleable Certification (“The Eleable Cert”) is a discretionary offering provided by Gabrie'le Eato LLC and/or Eleable LLC to recognize successful completion of a collaborative engagement. Issuance is not guaranteed and may be declined if the collaboration was not completed, was terminated prematurely, or did not conclude in a manner that aligns with the standards, values, or expectations of Gabrie'le Eato LLC and/or Eleable LLC.

The decision to withhold or decline an Eleable Cert is made solely at the discretion of Gabrie'le Eato LLC and/or Eleable LLC and does not entitle the client to a refund or other compensation. This policy is in place to preserve the integrity and meaning of the Eleable Cert as a representation of high-quality, professional collaboration.

This includes acceptance through electronic means such as checking a box, clicking “Subscribe,” or making payment via Stripe. You agree to be bound by all terms outlined in this policy and any customized plan agreement you enter into.
